A group of princely states with an oasis called Ajmer-Merwara Territory in British India were geographically named Rajputana. The twenty or so Rajputana states prior to the 20th century were dynastic and the rulers were the source of all executive, legislative and judicial powers of the states. Once the country freed itself from British imperialism, the process of integrating the principalities into larger entities began. The state of Rajasthan came into being in the period from March 17, 1948 to January 25, 1950 through the integration of 19 princely states.
The Rajasthan Union was inaugurated in Jaipur on March 30, 1949 by Sardar Vallabh Bhai Patel.At that time, the major states with a more or less British administrative style were Jaipur, Jodhpur, Udaipur, Bikaner and Kota. They had their own high courts with a subordinate judicial system. Before the inauguration of the new state, a committee consisting of Shri B.R. Patel, then chief secretary of PEPSU, Lt.Colonel TCPuri, Director of Health Services and Shri S.P.Sinha, Superintendent Engineer, CPWD was formed to resolve issues related to the location of the capital and the seat of the Supreme Court.
The committee presented its report on March 27, 1949, recommending that Jaipur be made the capital of the new state and that the Supreme Court be located in Jodhpur. The newly created state had five Supreme Courts in Jaipur, Jodhpur, Bikaner, Udaipur (the capital of unified Rajasthan based in Kota) and Alwar (the capital of the th Matsya state) with a total of 20 judges. The 1949 Order of the Rajasthan Supreme Court abolished these various courts and established a single Supreme Court for the entire state. Article 10(1)1 of the Order states:
“The Supreme Court shall sit in Jodhpur and, as the case may be, at such other place or location as Rajpramukh may from time to time appoint permanently or for a limited period”.Subsection (2) of Section 10 authorizes the Chief Justice to appoint one or more such Justices of the Supreme Court to sit at the place or places he designates. Exercising its powers under Section 1 Subsection (3), the Rajpramukh State issued a Notice on August 25, 1949, setting August 29, 1949 as the date for the inauguration of the Supreme Court of Rajasthan to Jodhpur.
On the same day, Rajpramukh, exercising his powers under Section 10 Subsection (1) of the Order, ordered that pending further orders, the Rajasthan Supreme Court would also convene simultaneously (1) in Jaipur to decide on the manpower of the nascent divisions Jaipur and Kota and (2) in Udaipur to divest the manpower created in Udaipur Division.
