The Mahatma Gandhi National Rural Employment Guarantee Act, or MGNREGA, 2005, formerly known as the National Rural Employment Guarantee Act, or NREGA, is a social security measure in India designed to ensure the right to work. This law was adopted on August 23, 2005. It aims to improve rural livelihoods by providing at least 100 days of paid work during the financial year to at least one member of a household whose adult members volunteer for simple manual work. Women are guaranteed one-third of the jobs provided under MGNREGA.
Another objective of MGNREGA is to create sustainable assets (such as roads, canals, ponds and wells). The job must be offered within a radius of 5 kilometers from the applicant’s place of residence and pay the minimum wage. If a job is not found within 15 days of submitting the application, the applicant is entitled to unemployment benefit. This means that if the government cannot provide jobs, it must pay some unemployment benefits to these people. So working under MGNREGA is a legal right.
Besides economic security and creation of rural assets, NREGA is said to promote, among other things, the protection of a favorable environment, the empowerment of rural women, the reduction of rural-urban migration and the promotion of social equality. The law was first proposed in 1991 by the then Prime Minister P.V. Narasimha Rao.[9] It was eventually passed by Parliament and its implementation began in 625 districts of India. Based on this pilot experience, NREGA was extended to all regions of India from 1 April 2008.[10] The government hailed the rule as “the largest and most ambitious program of the world’s social security and public works”.
In 2009, the World Bank criticized that action, along with other political restrictions on internal mobility, as hindering development. However, the World Bank called it “an excellent example of rural development” in its 201 World Development Report[13]. MGNREGA is mainly implemented through gram panchayat (GP). The Act noted that it provides many safeguards to promote its effective administration and enforcement. The law clearly states the implementation principles and institutions, the list of permitted works, the financial model, monitoring and evaluation, and detailed measures to ensure transparency and accountability.
